Terms of Use for TournyIQ

Welcome to TournyIQ! These Terms of Use ("Terms") govern your access to and use of the TournyIQ website and application (collectively, the "Platform"), including any content, functionality, and services offered on or through the Platform. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. Acceptance of Terms

By using the Platform, you represent that you are at least 13 years old and have the legal capacity to enter into these Terms. If you are using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Changes to Terms

TournyIQ reserves the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Platform or through other reasonable means. Your continued use of the Platform after such changes constitutes your acceptance of the new Terms.

3. Use of the Platform

3.1 Eligibility

To use the Platform, you must:

  • Be at least 13 years old (users under 18 must have parental consent);
  • Provide accurate and complete information during registration;
  • Maintain the security of your account credentials.

3.2 Permitted Use

You may use the Platform to participate in tournaments, access content, and engage with features provided by TournyIQ. You agree to use the Platform only for lawful purposes and in accordance with these Terms.

3.3 Prohibited Conduct

You may not:

  • Use the Platform to engage in illegal activities or promote harmful conduct;
  • Attempt to hack, disrupt, or interfere with the Platform’s operations;
  • Post or share content that is defamatory, obscene, or violates others’ rights;
  • Use automated systems (e.g., bots) to access or manipulate the Platform;
  • Impersonate another person or entity.

4. User Accounts

To access certain features, you must create an account. You are responsible for:

  • Providing accurate registration information;
  • Keeping your account credentials confidential;
  • All activities that occur under your account.

TournyIQ may suspend or terminate your account if you violate these Terms or engage in conduct that harms the Platform or other users.

5. User Content

5.1 Ownership

You retain ownership of any content you submit to the Platform (e.g., tournament entries, comments, or profiles) ("User Content"). By submitting User Content, you grant TournyIQ a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content for the purpose of operating and promoting the Platform.

5.2 Responsibility

You are solely responsible for your User Content. You represent that your User Content does not:

  • Infringe on intellectual property or privacy rights;
  • Contain harmful or offensive material;
  • Violate any applicable laws.

TournyIQ reserves the right to remove or modify User Content that violates these Terms.

6. Intellectual Property

All content, trademarks, and materials on the Platform (excluding User Content) are owned by or licensed to TournyIQ. You may not copy, distribute, or create derivative works from such materials without prior written consent from TournyIQ.

7. Payments and Fees

Some features of the Platform, such as tournament entry fees, may require payment. All payments are processed through third-party providers, and you agree to their terms. TournyIQ is not responsible for issues arising from third-party payment processors. All fees are non-refundable unless otherwise stated.

8. Termination

TournyIQ may suspend or terminate your access to the Platform at any time, with or without cause, including for violations of these Terms. Upon termination, your right to use the Platform ceases, but provisions related to intellectual property, disclaimers, and liability survive.

9. Disclaimers

The Platform is provided "as is" without warranties of any kind, express or implied. TournyIQ does not guarantee:

  • The Platform will be uninterrupted, error-free, or secure;
  • The accuracy or completeness of any content;
  • The outcome of any tournaments or competitions.

10. Limitation of Liability

To the fullest extent permitted by law, TournyIQ and its affiliates shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform. Our total liability for any claim shall not exceed the amount you paid to use the Platform.

11. Indemnification

You agree to indemnify and hold harmless TournyIQ, its affiliates, and their respective officers, directors, and employees from any claims, damages, or losses arising from your use of the Platform, your User Content, or your violation of these Terms.

12. Governing Law and Dispute Resolution
